TERMS OF USE FOR MARGRAM

Effective Date: 10.07.2025

These Terms of Use constitute a legally binding agreement ("Agreement") between you ("User") and Marine Solutions SD Group LLC, a company registered in Ukraine ("Administrator"), regarding your use of the MARGRAM Service ("Service" or "MARGRAM") available within the Mobile Applications: "Marine Survey", "Marine Survey Pro", and "Marine Survey Assistant" ("Mobile Applications").

By accessing or using MARGRAM, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of these Terms, you must not use the Service.

1. GENERAL TERMS
   1.1. The Service provides Users with access to a digital platform for informational purposes and personal communication, including sharing of messages, files, images, and user profiles.
   1.2. This Agreement supersedes any prior agreements between the User and Administrator regarding the Service.
   1.3. Administrator reserves the right to update these Terms at any time. Continued use of the Service constitutes acceptance of any modifications.
   

2. ELIGIBILITY
   2.1. You must be at least 18 years old to register and use the Service. By using MARGRAM, you represent and warrant that you meet this requirement.
   2.2. You must use only authorized means to access the Service and ensure your device is compatible. The Administrator is not liable for incompatibility or use on unauthorized devices.
   

3. USER REGISTRATION
   3.1. Access to MARGRAM requires User registration through the Mobile Applications.
   3.2. Registration is completed via email, Google Account, or Apple ID.
   3.3. The User is responsible for ensuring that the information provided is accurate. Administrator may suspend or delete accounts for providing false or misleading information.
   3.4. User accounts may be terminated due to inactivity (12 months), violations of laws, or breaches of these Terms.
   3.5. The User is responsible for the confidentiality of login credentials and must promptly report any unauthorized use.
   

4. PERSONAL DATA
   4.1. Administrator processes User data in accordance with applicable laws and the Privacy Policy.
   4.2. By using the Service, Users consent to the collection, storage, and use of their personal data (email, Google/Apple ID, etc.) for registration and service functionality.
   4.3. Users may receive email or push notifications as part of service communication.
   

5. ACCEPTABLE USE
   5.1. Users may share content, participate in discussions, and communicate with others within MARGRAM for personal, non-commercial purposes.
   5.2. The following content and behavior are strictly prohibited:

• Hate speech, harassment, or offensive content.

• Pornographic or sexually explicit materials.

• Fraud, deception, or solicitation for money without administrative approval.

• Spam, unsolicited ads, or any unapproved promotional content.

• Copyright-infringing materials or content violating third-party rights.
  5.3. Administrator reserves the right to delete or restrict content or accounts at its sole discretion without prior notice.
  5.4. Users are solely responsible for any content they upload and agree to indemnify the Administrator against any third-party claims.
  

6. CONTENT AND INTELLECTUAL PROPERTY
   6.1. By posting content, you confirm that you own or have permission to share such content.
   6.2. Administrator is not responsible for user-generated content and does not guarantee its accuracy.
   6.3. The intellectual property rights to the Service, Mobile Applications, and platform infrastructure belong solely to the Administrator.
   

7. PAYMENTS FOR ADVERTISING
   7.1. Users may purchase advertising services within MARGRAM.
   7.2. All payments for advertising are made exclusively through the Wayforpay international payment system.
   7.3. The Administrator does not collect or store your payment card details. Payment is processed through the secure Wayforpay gateway.
   

8. DISCLAIMER AND LIMITATION OF LIABILITY
   8.1. The Service is provided "as is" without warranty of any kind.
   8.2. Administrator is not liable for any damages arising from use or inability to use the Service, including data loss or security breaches.
   8.3. Administrator may limit, suspend, or terminate access to the Service at any time without liability.
   

9. GOVERNING LAW
   9.1. This Agreement is governed by the laws of Ukraine.
   9.2. Any disputes shall be resolved in the courts at the location of the Administrator.
   

10. FINAL PROVISIONS
    10.1. This Agreement does not create any partnership, agency, or employment relationship between the User and Administrator.
    10.2. If any provision of this Agreement is held invalid, the remaining provisions shall remain in effect.
    10.3. Failure of the Administrator to enforce any provision shall not constitute a waiver of its rights.
